What is the base percentage for the 2026 rent increase in Québec?+
For leases starting between April 2, 2026 and April 1, 2027, the Administrative Housing Tribunal (TAL) sets the base percentage at 3.1%. This percentage is revised annually by the TAL.
How are municipal and school taxes factored into the calculation?+
Only the portion of the tax increase that exceeds the base percentage is taken into account. This excess is spread over 12 months and across the number of units in the building, then added to the base adjustment. The same principle applies to changes in the insurance premium.
What counts as major work in the TAL calculation?+
Eligible major work (capital improvements) is amortized over 20 years, at a rate of 5% per year, spread across the units served by the work. Roof resurfacing or replacing a central heating system are typical examples — routine maintenance repairs are not eligible under this category.
Can a landlord impose this increase without the tenant's agreement?+
No. The landlord must send a lease modification notice within the timeframes set by law. The tenant can refuse the increase; failing an agreement, either the landlord or the tenant can apply to the TAL to settle the dispute.
